
Want to start a fight? Suggest that pit bull-type dogs are dangerous and should be banned. Folks who love the dogs will trumpet all their outstanding characteristics and, probably, accuse you of animal racism.
Diane Elmore, who lives in an unincorporated neighborhood just east of Colorado Springs, never looked down on pit bulls. Until last August when Susan Polston moved in with her 8-year-old son and two pit bulls, Achilles, below, and Asia.


Then, in October, Achilles confirmed their fears when it jumped over the fence and attacked Moonbear. Elmore’s 16-year-old son, Matthew, witnessed the attack and managed to free his pet, which suffered cuts to the ears and neck.
An animal control officer from the Humane Society of the Pikes Peak Region investigated, found probable cause to cite Polston for a misdemeanor charge of owning a dangerous animal and impounded Achilles.
Trial is set May 21. In the meantime, Achilles has been stuck at the animal shelter, which charges Polston $10 a day kennel fees. Polston has spent more than $2,100 in fees, spent $1,500 on an attorney and is angry that her dog does not get exercise while stuck at the shelter.
Elmore is upset at the prospect Achilles might be returning to the neighborhood. Especially after a second incident involver her and Asia, Polston’s female pit bull. Elmore said Asia tried to jump the fence and attack her, a couple weeks after Achilles bit Moonbear.

Wes Metzler, president of the humane society, said it’s unlikely a judge will order Achilles destroyed since the attack ended with relatively minor injuries to Moonbear, below.

But he said a judge likely will order Polston to build a secure enclosure to prevent Achilles or Asia from getting out by jumping, climbing or digging.
And he’s surprised how long it has taken for the case to reach trial. He said Polston could have petitioned the court to allow her to move Achilles, below, to a private boarding kennel where the dog could have daily exercise.

As for the debate about pit bull-type dogs and whether they are safe, here are a few things to consider . . .
In January 2009, the Pentagon banned from Army housing all dog breeds it deemed “aggressive or potentially aggressive” pit-bull types such as American staffordshire terriers and bull terriers, as well as rottweilers, doberman pinschers, chows, wolf hybrids and any others that display a dominant or aggressive behavior.
The Pentagon memo, dated Jan. 5, 2009, exempted those dogs already living on Army bases. If a soldier with a banned dog transfers bases, however, it would be subject to the ban. The Air Force also has enacted a breed-selective policy and the Navy is expected to do the same.
Consider statistics gathered by the Centers for Disease Control. According to the CDC, between 1979 and 1996, 279 people in the U.S. were killed by dogs. Of these, 60 were killed by pit bulls. Rottweilers were second most-deadly with 29.
In a 2000 study, the CDC reported at least 25 breeds of dogs were involved in 238 human dog bite-related deaths during the previous 20 years. Pit bull-type dogs and Rottweilers were involved in more than half of
these deaths.
Many nations have breed-specific laws banning the import, sale or breeding of certain types of dogs, such as pit bulls, according to Dogsbite.org, a group dedicated to reducing serious dog attacks by creating laws.
According to information on the group’s Web site, 250 U.S. cities have some sort of ban on pit bull-type dogs.
In addition, some states are considering tougher restrictions on them and debating whether to require their owners to carry extra insurance on them. That’s because many insurance companies will no longer insure homeowners who keep the dogs.

Denver has a pit bull ordinance. This site says why they passed the law because of pit bull attacks. Among other facts, “Between 1984 and May of 1989, pit bulls attacked and seriously injured more than 20 people in Colorado,including three years old Fernando Salazar, who was fatally mauled by a pit bull in southwest Denver inOctober of 1986.” How dangerous does a dog have to be before the courts put it down? Colorado has 18-9-204.5. Unlawful ownership of dangerous dog. Can you tell me WHY a breed ban is necessary when this law thoroughly protects citizens and their property from ALL types of dogs?
Municipalities, County and State Govts. nationwide are finding the COST of defending and enforcing BSL is far greater than the effect they hoped their knee-jerk reactions to a HUMAN problem would have. Huntsville, Denver, Miami, Baltimore….the list is nearly endless.
Mrs. Elmore is my daughter in law & it really concerns me that my family has to be afraid to go into their own backyard. I know Moonbear (Elmore’s dog) very well & she is a mild mannered, well trained, sweet dog. I think it is absurd that a dog like the pit bull is allowed to injure that sweet dog & terrorize the Elmore family. My grandson, Matthew, could have been seriously hurt trying to pull the pit dog off of Moonbear.
I pray that something will be done to make it totally safe for my family to enjoy their home without fear of the next door vicious dog.
Mrs. Spencer, I could not agree with you more on the fact(s) that your family should be able to enjoy their backyard without fear, and that Moodbear should not be attacked in her own yard. My concern is the attack on an entire breed of dog that is unjust and based on opinion. Let me ask if you would share your opinion, since the original article states that your daughter had no problems with Pit Bulls prior to her neighbor moving in with THESE two…is it YOUR belief that ALL Pit Bulls are vicious or that these two specific dogs are a problem and require intervention by law enforcement?
I would like to state that RESPONSIBLE DOG OWNERS of any breed want to ensure the safety of their dog by protecting it from Vicious Dog Laws that are currently on the books. This means (all breed) owners behave similar to the description of how Ms. Elmore has raised Moonbear. Some owners believe they are responsible and caring but fail to educate themselves on how to raise a well-mannered, socialized, enjoyable pet. That is NOT breed specific…that is HUMAN NATURE, and unfortunately creates ‘victims’ such as Moonbear….but also dogs such as MINE that aren’t vicious, have never displayed a vicious/aggressive instinct toward anyone, other dogs, cats nor horses.

The County of Denver, despite a draconian pit bull ban enacted in 1989, has a significantly higher rate of dog bite hospitalizations than any other county in the state, according to the Colorado Department of Public Health and Environment statistics.
The Colorado Trauma Registry Database classified Denver County with a rating of “H,” that is, with an “injury rate higher than the rest of the state” over a twelve-year period (1995-2006).

The ban has NOT reduced bites, injuries or made the community safer.
Breed Specific Legislation, BANS, do not promote community safety. It instead provides a sense of false security to a community, not to mention the cost to tax payers for defending such efforts in the courts (as proven to drag on forever at the dogsbite site linked by Aneida S).
There are better ways, there are SUCCESSFUL ways to handle vicious dogs IF the current laws are not working (which they should be if they were being ENFORCED). Breed banning is NOT the answer, just an illusion.
I have to wonder how many OTHER minor dog on dog attacks have occurred from OTHER dogs in the immediate area that has NEVER made the news or been “blogged” about.
The FACT is that Pit Bull attacks are grouped together with 3 different breeds included in ONE snf that does not include the normally 23 other official breeds that are commonly mistaken for these dogs.

I live in the neighbor that the Polston’s and Elmore live in. I have two children, a 16 month old little girl, and a 11 daughter. We are over there alot. The very first time I came to visit the dogs were very friendly. Asia the female pit in the home is very gentle. She does bark, like most dogs.
I’ve been over there when the neighbors were in they’re backyard looking inside a shed thing that’s right next to Susan Polston’s yard. And Asia, this so called aggressive dog was sitting on the porch not doing anything. I have witness and have photos of Elmore’s dog in they’re yard several times. Dogs are dogs. I am a very protective mother, and I can judge animals very well, having grown up with dogs all my life. Yes some dogs are more aggressive than others, but it depends on how you raise them. These dogs are inside dogs for one, and are part of the family. They are babied and treated like humans. They don’t have the first clue in how a “real dog” should act. Come on, this is a very sensitive issue for alot of people.
where to start……i really feel for the owners, on both sides, but i have been a victim of the wonderful people of the humane society. i to own and have owned pitbulls. they are the best and most loyal dogs i have ever been around. they will go to the end of the world to protect their owners, and do even more to make their owners happy. this poor dog is only where he is because he is a pitbull. a vicious dog would have killed her dog and then gone after her son.
about 4yrs ago we had a simular thing happen w/ us. we had 3 pit bulls at home, because we breed. the humane society harassed us WEEKLY and it was always the same lady.
sadly, one day they got out of the yard because they utility meter reader did not shut the gate right. they got a hold of a cat and yes they killed it. but last time i checked, that’s the what dogs do…..they chase cats and sadly sometimes they kill them. they owner of the cat did not want to make a big deal of a bad situation. she told the humane society officer this.
but the humane society officer insisted that we surrender the dogs. this was the same witch that had been harrassing us from day one. again the owner of the cat did not want anything done to the dogs. the officer made my husband load all 3 dogs into her truck and off they went. the dogs were put down before we even went to court. but we still had to pay for the few days all 3 were there, at $10 a day. i tried to find a lawer to help me but i was told by most that i would lose my case just because of the breed.
after all of this happened we rented our home out and moved because the same humane society officer would come by our house almost everyday, looking in the yard for any new dogs. i have been told by other pitbull owners that they have been treated the same way by our fabulous colorado springs humane society.

I’m glad you shared the other side of the story Winnie Rae, that puts an entirely different spin on this report. KNOWING a dog is proned to violating another dogs ‘territory” will put any dog on offense. Its not a matter of ‘viciousness’ when this occurs, its NATURAL CANINE BEHAVIOR. Is it a form of aggression? In the human definition, YES. But there are numerous degrees/types of Canine Aggression, they don’t all equate to viciousness (from any breed/type of dog).
You may have a dog that has fear aggression, food aggression, dog-on-dog aggression, prey drive/aggression, and so on and so on. That does NOT mean the dog is vicious nor dangerous if in a controlled situation – ie ‘trained’.
I’m so thankful this young man was not bitten accidently in this dog-fight…without doubt the offending dog would have been the Pit Bull in the authorities eyes whether he was actually the guilty party or not. Most times, an owner is bitten in that type of situation by his/her own dog. But dog bites are painful, and the boy was lucky he was uninjured. Of course, I have only been bitten once, by a GERMAN SHEPHERD, and that was when I was small and the dog actually was attacking my bicycle…I just happened to be attached to it. It was his natural response as a result of other kids in the neighborhood on bicycles tormenting him and threatening his territory with sticks….the day I happened by on my bike — the dog came over the fence.
Achilles could very likely have been reacting to the same situation. If the dog had previously invaded, he may have believed he had to protect what was his to protect. Of course, the boy opened the door and let the dog out…perhaps it had been in the yard and Achilles brought it back across.
I’ve yet to see/know/hear of any dog of any breed that recognizes property lines by deed or reads/comprehends Mans Laws.
jennifer — your story breaks my heart. But unfortunately as a result of so many hyped up media accounts, the general public remains uneducated to the facts and invisions the boogey-man in their nightmares instead of understanding the dogs are just dogs or attempting to learn the facts. You paid a high-price for others inability and unwillingness to look at the problem as it really is and that is a pity. It absolutely blows my mind that people can’t recognize for the few stories they hear/read in the news, the 1000′s more they never hear of the GOOD DOGS…and yes I mean Pitties!

Jo, I never said the dog was in NO WAY aggressive. I know alot of dogs that are aggressive. I use to have a friend who owned a poodle and was so sweet until you came near her owner, then she’d bite you and try to pull you to the ground. There is indeed alot of ways to show aggression, but when reading what Elmore and others who know nothing about The Polstons dog, except what they’ve read in this article, I thought I was pertinent to state that if Achilis was in fact as aggressive as he’s made out to be. Since the boy walked away and the dog was only scratched on his ear. Anyone who knows anything about a vicious dog knows that this situation is clear, this dog was not trying to do anything but be a dog. I think it shows a great restraint on the dogs part. I wasn’t there that day, but I can’t say that the dog wasn’t antagonized or provoked. But I do know animals. Violent dogs normally take limbs or even lives. That’s scary to think about but sadly true.

The overwhelming problem with animal enforcement in El Paso County is the lawlessness and arrogance practiced by the Animal Control officers.
While they are paid with funding from the County, they are technically a private entity – Pike’s Peak Humane Society – that allows their officers – and I use the word loosely – to ignore all elements of due process, civil rights and common sense.
Many jerks will move next door to a dog and then claim they are scared of it and use Animal Control to harass the law abiding people who own the dog and were there first.
El Paso County needs to cut off funding immediately to this rogue organization and assign animal control issues to a legitimate public entity that will abide by applicable laws.

Jennifer, I’m very sorry to hear what happened to you, but I believe that may be the same animal control officer I had issues with.
I was living in Pueblo (same animal control organization), and we had a Great Dane/German Sheperd cross that “followed” our boy home one day. We attempted to find the owners and never did. the vet estimated him to be four months old, but “Tiny” was already bigger than our Cocker Spaniels, and the four foot chain link fence would not hold him. As a result he got out many times until we were able to build a big enough restraint to keep him in our yard. He never bit anybody, but did scare the little kids that he loved to pieces and licked. As a result, we recieved three tickets for a dog at large. six month after he came to us, he was gone. A boy was bitten while riding his bicycle by a yellow dog – natrually, as we were known to have a yellow dog that got out, animal contol issued a summons. On the day and time in question he was inside the house having breakfast with us. Netherless, the court ordered us to put him down. The same officer that wrote the summons was the one at the animal shelter that recieved him, the same one that came to our door two weeks after we took tiny over to the shelter looking for him, kept writing us up for dogs at large…. and the same one I got pictures of opening my gate one day when my car was in the shop and it looked like nobody was home. I made a complaint and didn’t see her again until I moved up to Fountain to be closer to my job. she wasn’t fired, just transferred. Needless to say, I did not stay in El Paso County. One of the things I looked at where I am now is what organization runs the animal shelter, because my dogs have always been able to find the smallest hole and get out without any help. Teller County runs it’s own animal shelter, and has worked with me when funds were low to fix fence, and other things.
Time for me to get off my soapbox.
I live in Kentucky & last week a family pit bull attacked 4 people in his family & tore them up pretty good. They had to air lift them to a hospital. If people insist on keeping these dangerous dogs, they must keep them well fenced in & not let them be around other people. If they do not fear for themselves, that is ok, but others should not be exposed to that danger.
I love dogs & I love Moon Bear. She is lucky to be alive.

I have to say that I am allways dissapointed to hear the ignorance of people who haven’t done their research. It has been PROVEN IN RECENT STUDIES THAT THE MOST AGGRESSIVE DOG IS A DACHSUND HOUND! The reason you don’t hear about many attacks is because most people are too embarrased to call and complain that they got bit by a weenie dog. Further more unless you have ever owned a pit bull you would not fully understand the benefits that they have to offer. I am sorry to hear about your family member , but to be frank would you be writing if it was any other dog.
It is very disappointing when people are so ignorant, and are slanderous just to get the attention away from the real Legal/moral/personal issues here. This is not a debate about what dog species is the most vicious. Of course people would be writing about these issue and social Hazards even if their family was not involved. Any person with any sense of a good moral code would do the right thing and fight for what is right, morally,y and Legally, instead of bringing up lies and other topics. There is no question about being embarrassed about legal issues, either one chooses to do what is right and take legal action to help fix the problem, no matter what it is. We as people of the United States have laws to protect our civil liberties, and anyone who takes advantage of them, or tries to get around the laws of the land, should live in a non-free country for a while to realize how privileged we are to live with laws, and a government which tires it’s best to keep it’s people SAFE. Safety and social hazards are the main topics here, involving Pitbull cases. Not different peoples INGNORANT personal opinions on species of dogs.
Embarrassment to report any legal issues is one of the biggest problems as to WHY so many attacks and violence, either to humans or other dogs, go unreported. It’s also why they must to be reported, to put the attacker, either human or canine, in their place and make society a safer place for those who cannot so easily protect themselves from danger. It’s the same reason molestation and rape go unreported, or domestic violence and abuse. Someone will always be embarrassed to report for fear of being looked down upon, but that is why their voices need to be heard instead of being covered up, manipulated, or adulterated due to the pushing of one’s own agenda. Yes, it is true that many pit bulls live out wonderful lives with their owners, without ever taking a snap at anyone, but many other pit bulls have attacked, mauled, and in some cases, killed other dogs, adults, and children. Could one really think that a dachshund could do the same damage? It is a known fact that aggression in dogs is not breed specific, that all canines are capable of exhibiting aggression, but depending on the capacity of each breed to cause damage is overlooked. One ignorant accusation may be that smaller dogs are more aggressive, but smaller dogs aren’t able to maim the way pit bulls can. Pit bulls have powerful jaws and bodies, enough to chase down a child, close the jaws over flesh and cause serious harm or death. These dogs were bred to kill for many years, therefore its inextricably in their genetics to have that greater ability. I’m not saying that pit bulls should be banned, but anyone who owns a pit bull should realize that the inherent risk that comes with that god will require some greater precaution and responsibility, and when that dog attacks another person or human, should be prepared to face that responsibility rather than making excuses, lies, or manipulating the facts.

It’s interesting how a baby crib with sliding side rails can be banned from about 50 years production and sale after the somewhat recent deaths of 5 babies within a 20 year time frame, but pit bulls, who have attacked hundreds of people and other animals and have killed many people over the same time span aren’t banned.
If pit bulls were a consumer product, they’d have been banned nationally a long time ago.
July 20, 2010 There doesn’t seem to be an end to the deaths caused by pit bulls.
(CBS) One person is dead and three others are hurt after a pit bull attack, reports CBS affiliate WREG in Memphis.
William Parker, 71, was attacked by two dogs while walking from one yard to another.
Parker died after being taken to the hospital.
When firefighters arrived on the scene to treat the man, two of them were attacked. They were treated at a local hospital and then released.
A woman, reported to be the dead man’s daughter, was also injured and is listed in non-critical condition.
The owner of the dogs was arrested this past weekend for violating the sex offender registry act.
Anyone that QUOTES dogsbite and relies on THEM for stats is NOT informed. THEY are a BSL LOBBY GROUP whose only funtion is to SEE all short haired medium sized dogs BANNED. It does not matter the temperament, training or disposition. They get their “stats” from MEDIA reports and as WE all KNOW any dog that attacks and can be LABELLED a pit bull type dog IS. Every single LEGITIMATE organization is AGAINST BSL and WHERE is the information showing the DISMAL FAILURE of BSL worldwide? The Netherlands, Germany and Italy (was up to 98 banned and/or restricted dogs) have RECINDED BSL based on DOCUMENTED evidence that there was NO difference in dog bites or attacks. England is looking to recind as is Scotland AND Denver is also considering it.

As an owner of German Shepherds, i face just as much hassal and prejudice as owners of bullie breeds. People fear what they dont understand and many people have such difficulty understanding a dog that is intelligent, they would rather ban and destroy because thats human nature instead of do better. Now i’m not going to sit here and tell you that all dogs are perfect because in reality, thats a blatant lie. Yes some dogs are amazing and wonderful while others, due to extremely bad breeding and/or extremely bad handling, are just the worst. Now i’m terrified of great danes because one that was friendly with everyone else decided i was a threat. I was checking my mail and heading back to my apartment when the damn beast charged down the hall and decided to chew on me in a non playful manner. What people fail to realize is that a dog is only doing what comes naturally. Now the dogs that are actually dangerous, i am in complete agreement shouldn’t even be given a chance. I’m an animal lover. Always have been. But there comes a time when certain circumstances bring about certain consequences. Bad ownership is the general reason for bad dogs.
I am thoroughly against BSL because i feel its ignorant and targets those who are responsible owners. It destroys families. I have encountered many “vicious” dogs and not once has it been a breed you would normally expect it to be. No, smaller dogs cant cause the kind of damage larger dogs can in a short amount of time but they are still capable of killing a person. Too many fabulous dogs are killed each year due to breed prejudice. Now having heard two sides to this story, it sounds as though the dogs were simply doing what dogs do. A stranger trespassed into their territory and they reciprocated. I am a person who feels a 6 foot PRIVACY fence should be in place at every home to help avoid issues like these but truth is, people are cheap. Dogs who get out and cause trouble, yes, thats a problem. The dogs who DEFEND their homes are simply doing what they should. I’ve heard too many stories of pitbulls and various other breeds being put down simply because they were protecting their family. I’m not saying that these dogs attacking the other in his own yard is right. What i’m saying is people should stop being prejudice simply because breed reputation. Do the research. Learn about something before you judge it. As for those who say bullie breeds were bred to fight. Well thats not always true. Pits were ALSO created to be nursemaid dogs. These dogs were trained to follow the nursemaid around and perform specific tasks to help make the job easier and to comfort and protect. Stop banning the breeds. Personally i would never have a chow or akita in my home but thats a personal choice. I dont particularly care for the breeds. But whats right for others isnt always right for someone else. Direct the blame to the owners who deserve but also understand a dog is still a dog no matter what. They have instincts. People… well people aren’t always the smartest as i’m sure you all know. Simply driving down the road can be a trial on ones patience of how ignorant other people can be. Dogs do what dogs do and people judge and hate and throw stones because we dont know anything else. Its easier to blame someone else, rather than ourselves. Think about it. How often have you blamed someone else for something you did in the hopes it made you feel better? Breed banning will only bring about further ignorance and might make you happy but what about those who are respsonsible pet owners? What about those who have done the research on a specific breed? Are you going to automatically assume a dog is bad simply because of what breed it is? Its very similar to the prejudice that made life so hard for blacks many years ago. I’m white. Skin color doesnt matter to me. neither does breed. DONT JUDGE A BOOK BY THE COVER! You’ll miss a good story. I used to have a American Staffordshire Terrier and she was the best and the kindest dog ever to our family. One day we took her camping with the family but our cousins live out of the state and she only seen them once before I was playing tag and she thought my cousin was trying to hurt me and he ran by the tree where my dog Chocolate was and she nipped at him but she was only being protective over me and my brother soooooo…… We did the right thing and had to put her down.
